I would be looking at a "not fit for purpose" approach with the dealer. If you have given them a chance to fix an issue and it still is a problem then you have a strong case.

Sounds like the age-old Ducati back brake problem.
On 916 type bikes they need regular bleeding, I suspect it's to do with the master cylinder being bolted to the exhaust mounting bracket onto the engine block boiling the fluid? as the, almost identical setup* on the Monster is fine. That said even when bled they aren't up to much and I always have crossed fingers when on the MOT brake tester. * by almost identical, I mean the same master cylinder and caliper, significant differences being master cylinder mounted on footrest (so not heated) and rear disc is slightly bigger, accounting for stronger braking.

The rear brake on my M1000 and M1100evo were both fairly useless and required regular bleeding to stay vaguely useful. The rear brake on my SF848 is much better when it works, but it also suffers from being fairly ineffectual most of the time. Immediately after not being used for 3-4 months over winter the rear brake was great, but after a few rides it was back to being a pointless piece of equipment that only gets through the MOT because my tester is very understanding and knows that Ducati rear brakes aren’t actually designed to work.
