View Full Version : Assaulted: What way for legal action?

Feeling really sore at present, was set-upon last night by a group of lads as my housemate and i walked out of the pub. - yes, unprovoked.
spent last night in a&e, where i gained the addition of 7 stitches to my lip (apparently jonny wilkinson had 14??) and some glue on my head to hold a split/tear together. I also have a thoroughly bloodied and swollen nose.

Now I am really pissed off with stuff like this. Been to the police station this morning when i was finally discharged and they were interviewing the lad they arrested (caught in the act) I have filed a case for assault. Are they just likely to get an asbo and slapped wrist? how far can i take it? can I seek litigation for this? I really wanna screw-over these B***ards and take this as far as i can.

Any advice from anyone would be a comfort...

Feckin hell mate. Hope you get better soon. I had the same thing happened a few years ago. I went to court and gave evidence. They got community service. That was nearly 10 years ago so no doubt, with todays nanny state, you'll be the one in the dock getting done for threatening behaviour cos you want them charged!!

I hope they get the book thrown at them for it though.

Mate I'm really sorry to hear this. Sorry I can't be of much help with what you're asking, but as Bodybag says I hope they hang the little b*stards up by their tiny little b*llocks.

From my experiences with the law in this country you are wasting your time pursuing any action through the courts

The losers won't have any money so you won't get any compensation from them

The nanny state has a lot to answer for

Cheers for the support guys. Apparently lips heal really fast, but not soon enough to get me in the office for monday morning! :biggrin:
Never thought it'd happen to me, need to make sure my mum doesn't find out, she'll worry worry worry.

Ah well, it'll all be sorted come the time for getting the bike out of the garage. Something to look forward-to I guess.

Some youth over here assaulted one of the security staff at a casino, they had the video of him stamping on the poor guy when he was on the floor, he's looking at 20 years.

I've never understood that mentality in people, bit like the twats who carry knives around just in case or the guy who could quite happily break a glass and shove it in your face for looking funny. Luckily throughout my adult life I managed to avoid it. Fods the pacifist.

Noli illigitimi carborundum I think (don't let the bastards grind you down)!!! Alternative is to find them in the dark one night and get one of your larger mates to scare the **** out of them. They won't get done by the courts but what goes round comes round so they'll do it to the wrong person one day. Natural justice usually works. Take care, keep your chin up (unless that's been damaged too)!!

I'm really sorry this happened to you. Some of the comments on here are correct. If this is his first offence he may well get off light. But you have to see it through all the way. Next time it'll be his second offence, and then it will be treated more seriously, and so on. This also may not be his first offence.
I won't tell you what I would do as it's certainly illegal and I wouldn't condone anyone taking the law into their own hands.
I have always held the view that we are all born equal. Born with the same right to live our lives without being assaulted, robbed, threatened. Once someone steps over that line then I believe they lose ALL their rights. The law of self defence is a joke. If I defend myself, either at the time, or some later date, and that response is not deemed to be in direct proportion to the offence committed to me, then that's just tough.

I'm sorry to hear you have been on the end of scum, I see this everyday at work and it seems to me to be getting worse!! I take it the police have taken pictures of your injuries, the one on here is good, and that witnesses were rounded up and a statement taken from yourself and your mate.

At the end of the day it depends on the blokes previous and what charges they bring, was he bailed (quite likely), did he go to court the next day (this I doubt) oh and the CPS? I hope someone will keep you informed but make sure you know who the Officer in the Case is. If it does go to court which I would hope it would, the witness care unit should keep you informed - you can always speak to the Officer to find out what is going on - Good Luck!!!

Oh if it goes to court you may be able to claim compensation, mention this as well!!

Sorry to hear about this. There's just no excuse for it.
As for legal matters...me reckons the uselessness in solving crime is equally bad both ways. Hence I have a few ideas of what I'd do. But I certainly won't recommend it.
As mentioned earlier...push it as far into the legal system you can.
